A BILL TO BE ENTITLED
AN ACT
relating to certain state agencies maintaining automated external
defibrillators on the premises.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 779, Health and Safety Code, is amended
by adding Section 779.009 to read as follows:
Sec. 779.009. AUTOMATED EXTERNAL DEFIBRILLATOR AT CERTAIN
STATE AGENCIES. (a) In this section, "state agency" means a
department, commission, board, office, authority, council, or
other governmental entity in the executive branch of government
that is created by the constitution or a statute of this state and
has authority not limited to a geographical portion of the state.
The term does not include a university system or institution of
higher education as defined by Section 61.003, Education Code.
(b) A state agency shall have available an automated
external defibrillator at each location at which the state agency
has 100 or more full-time equivalent employees.
(c) The state agency may accept an automated external
defibrillator as a gift to meet the requirements of this section.
SECTION 2. This Act takes effect September 1, 2003.
