A BILL TO BE ENTITLED

AN ACT

relating to the relocation of utility facilities on certain state 
highway contracts.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 203.092, Transportation Code, is amended 
by adding Subsection (e) to read as follows:
	(e)  A relocation may not be made unless the department:                
		(1)  establishes the qualifications for each entity 
that will perform the relocation work activities; and
		(2)  if the utility accepts bids for the relocation 
work activities, approves the bidders list.
	SECTION 2.  This Act takes effect September 1, 2003.
