A BILL TO BE ENTITLED
AN ACT
relating to continued health insurance benefits for eligible surviving spouses of certain officers and employees of political subdivisions. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subsection (b), Section 615.073, Government Code, is amended to read as follows: (b) An eligible surviving spouse of a deceased individual listed in Section 615.071 who was employed by a political subdivision of the state is entitled to purchase continued health insurance benefits from the political subdivision that employed the deceased individual, including health coverage: (1) provided by or through a political subdivision under: (A) a health insurance policy or health benefit plan written by a health insurer; or (B) a self-insured health benefits plan; or (2) under Chapter 172, Local Government Code. SECTION 2. This Act is intended to clarify the law in effect and being administered immediately before the effective date of this Act. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
