A BILL TO BE ENTITLED

AN ACT

relating to a one year delay in implementing the nonpromotion 
provision for the third grade educational assessment program.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subsection (n), Section 28.0211, Education Code, 
is amended to read as follows:
	(n)  This section applies to the assessment instrument 
administered to students in:
		(1)  the third grade beginning with the 2003-2004 
[2002-2003] school year;
		(2)  the fifth grade beginning with the 2004-2005 
school year; and          
		(3)  the eighth grade beginning with the 2007-2008 
school year.             
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
