A BILL TO BE ENTITLED

AN ACT

relating to electronic monitoring devices in the rooms of persons 
with Alzheimer's disease who are residents of assisted living 
facilities.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter E, Chapter 247, Health and Safety 
Code, is amended by adding Section 247.069 to read as follows:
	Sec. 247.069.  MONITORING DEVICES.  The department shall 
adopt rules to provide for the placement of electronic monitoring 
devices by a family member in the room of a person with Alzheimer's 
disease who is a resident of an assisted living facility.
	SECTION 2.  This Act takes effect September 1, 2003.                           
	SECTION 3.  The Texas Department of Human Services shall 
adopt rules under Section 247.0291, Health and Safety Code, as 
added by this Act, no later than January 1, 2004.
