A BILL TO BE ENTITLED
AN ACT
relating to the administration of the medical assistance program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 22.002, Human Resources Code, is amended
by adding Subsection (j) to read as follows:
(j) If the Social Security Act is amended to make federal
funds available to states for the medical assistance program under
Title XIX of that Act on a block grant basis, as defined by federal
law, and the state elects to receive federal funds on that basis,
the Health and Human Services Commission shall have the authority
to spend state funds for the medical assistance program.
SECTION 2. Section 32.002, Human Resources Code, is amended
by adding Subsection (c) to read as follows:
(c) If the state elects to receive federal funds for the
medical assistance program on a block grant basis, as defined by
federal law, in accordance with a change in the Social Security Act,
the Health and Human Services Commission shall have the authority
described by Section 22.002(j), and any provision of this chapter
that conflicts with that authority shall be inoperative to the
extent of the conflict.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
