A BILL TO BE ENTITLED
AN ACT
relating to restricting the ability of a county to require a
building permit in the extraterritorial jurisdiction of a
municipality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 233, Local Government Code, is amended
by adding Subchapter Z to read as follows:
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
Sec. 233.901. COUNTY BUILDING PERMIT IN EXTRATERRITORIAL
JURISDICTION PROHIBITED. A county may not require a permit to erect
or improve a building or other structure in the extraterritorial
jurisdiction of a municipality, as defined by Chapter 42.
SECTION 2. This Act takes effect September 1, 2003, and
applies only to an application for a permit submitted on or after
that date. An application for a permit submitted before that date
is governed by the law in effect when the application was submitted,
and the former law is continued in effect for that purpose.
