S.B. No. 1282
AN ACT
relating to notice provided to certain entities that self-insure
for workers' compensation purposes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 409.021, Labor Code, is amended by
adding Subsection (f) to read as follows:
(f) For purposes of this section, "written notice" to a
certified self-insurer occurs only on written notice to the
qualified claims servicing contractor designated by the certified
self-insurer under Section 407.061(c).
SECTION 2. Section 504.002, Labor Code, is amended by
adding Subsection (d) to read as follows:
(d) For the purpose of applying the provisions listed by
Subsection (a), "written notice" to a political subdivision that
self-insures, either individually or collectively through an
interlocal agreement as described by Section 504.011, occurs only
on written notice to the intergovernmental risk pool or other
entity responsible for administering the claim.
SECTION 3. This Act takes effect September 1, 2003, and
applies only to a claim for workers' compensation benefits based on
a compensable injury that occurs on or after that date. A claim
based on a compensable injury that occurs before that date is
governed by the law in effect on the date that the compensable
injury occurred, and the former law is continued in effect for that
purpose.
