A BILL TO BE ENTITLED
AN ACT
relating to the authority of the board of pharmacy to create a new
class of pharmacy.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 554.001, Occupations Code, is amended by
adding a new subsection (e) to read as follows:
(e) The Board may establish additional classes of pharmacy
licenses if it determines that:
(1) the practice setting will provide pharmaceutical
care services to the public;
(2) none of the existing classes of pharmacy licenses
are appropriate for the practice setting; and
(3) a new class of pharmacy license is necessary to
protect the public health, safety, and welfare.
SECTION 2. Subsections (a), Section 560.051, Occupations
Code is amended as follows:
(a) Each applicant for a pharmacy license shall apply for a
license in one or more of the following classifications:
(1) Class A;
(2) Class B;
(3) Class C;
(4) Class D; or
(5) Class E.
(6) any other class created by the Board under the
authority granted in Section 554.001.
SECTION 2. Section 562.001, Occupations Code, is amended by
adding a new subsection (g) to read as follows:
(g) For other Classes of pharmacy licenses created by the
board under the authority granted in section 554.001, pharmacist
supervision shall be as designated by board rule. Such supervision
shall be no less than continuous supervision by a pharmacist
according to the needs of the pharmacy.
SECTION 3. This Act takes effect September 1, 2001.
