A BILL TO BE ENTITLED
AN ACT
relating to renewable energy credit for converting solid waste into electric energy. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 363, Health and Safety Code, is amended by adding Subchapter H to read as follows:
SUBCHAPTER H. WASTE TO ENERGY
Sec. 363.151. RENEWABLE ENERGY CREDIT. In furtherance of the state's policy of encouraging the conversion of solid waste to energy, a retail electric provider, municipally owned utility, or electric cooperative may credit toward satisfaction of the requirements of Section 39.904, Utilities Code, any production or acquisition of electric energy produced by a waste-to-energy technology in this state in an amount not to exceed 50 megawatts in total for all providers. In this section, "waste-to-energy technology" means any technology that relies on energy derived from municipal solid waste. SECTION 2. This Act takes effect September 1, 2003.
