A BILL TO BE ENTITLED
AN ACT
relating to the adoption of rules restricting the use of a medical practitioner's Federal Drug Enforcement Administration number. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 2, Chapter 1266, Acts of the 76th Legislature, Regular Session, 1999, is amended to read as follows: Sec. 2. The director of the Department of Public Safety of the State of Texas shall adopt the rules required by Section 481.003(b) [481.003], Health and Safety Code, not earlier than the 180th day after, and [as amended by this Act,] not later than the first anniversary of, the date on which compliance with a rule adopted by the United States Department of Health and Human Services creating a universal provider numbering system is required [January 1, 2003]. A rule adopted by the director of the Department of Public Safety under this Act takes effect on adoption [January 1, 2003]. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
