A BILL TO BE ENTITLED

AN ACT

relating to the PEIMS Report.                                                 
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 28.004, Education Code, is amended by 
adding the following:
	(k)  The commissioner shall report annually the number of 
school districts that:
		(1)  Have policies and practices in place that ensure 
students in elementary grades receive a minimum of 30 minutes per 
day or 135 minutes per week of physical activity.  The annual report 
should also include:
			(A)  How many times during the year the District 
School Health Advisory Council has met;
			(B)  Information about district adopted policies 
for ensuring that campuses follow TEA vending machine/food service 
guidelines for restricting student access to vending machines; and,
			(C)  Includes information about the policies and 
enforcement procedures for prescribing penalties for the use of 
tobacco products (by students and adults) on school campuses or 
school-sponsored events.
	SECTION 2.  Effective date September 1, 2003.
