A BILL TO BE ENTITLED
AN ACT
relating to the authority of a municipality to enforce water
conservation and drought ordinances.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter F, Chapter 402, Local Government
Code, is amended by adding Section 402.106 to read as follows:
Sec. 402.106. ENFORCEMENT OF WATER CONSERVATION AND DROUGHT
ORDINANCES. (a) A municipality with a population of more than
1,000 may impose a fine for the violation of a water conservation or
drought ordinance by including the amount of the fine in the monthly
water bill issued by the municipality if a schedule of fines is
clearly displayed on the monthly bill.
(b) A customer may appeal a fine imposed as provided by this
section to municipal court.
SECTION 2. This Act takes effect September 1, 2003.
