A BILL TO BE ENTITLED

AN ACT

relating to access to criminal history record information by a 
county fire marshal.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter F, Chapter 411, Government Code, is 
amended by adding Section 411.1237 to read as follows:
	Sec. 411.1237.  ACCESS TO CRIMINAL HISTORY RECORD 
INFORMATION:  COUNTY FIRE MARSHALS.  (a)  On request of the 
department chief or chief executive of a fire department or an 
emergency medical services provider for an unincorporated area of a 
county, a county fire marshal is entitled to obtain criminal 
history record information that relates to an employee or member of 
the requesting department or provider.
	(b)  The county fire marshal may disclose the criminal 
history record information to the department chief or chief 
executive of the requesting fire department or emergency medical 
services provider.
	SECTION 2.  This Act takes effect September 1, 2003.
