A BILL TO BE ENTITLED
AN ACT
relating to eligibility for graduation from high school for certain
public school students.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.025, Education Code, is amended by
adding Subsection (c-1) to read as follows:
(c-1) Notwithstanding Subsection (a) or Section 28.025, a
student in grade 10 during the 2002-2003 school year may not be
prohibited from receiving a high school diploma on the basis of the
student's failure to perform satisfactorily on an assessment
instrument adopted under Section 39.023(c) that is first
administered during the 2002-2003 or a subsequent school year. To
receive a high school diploma, the student may be required to
perform satisfactorily on an assessment instrument adopted under
Section 39.023(c) and first administered before the 2002-2003
school year. This subsection expires September 1, 2006.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
