A BILL TO BE ENTITLED

AN ACT

relating to an intercollegiate athletics fee for students at 
Prairie View A&M University.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter E, Chapter 54, Education Code, is 
amended by adding Section 54.5392 to read as follows:
	Sec. 54.5392.  INTERCOLLEGIATE ATHLETICS FEE; PRAIRIE VIEW 
A&M UNIVERSITY.  (a)  The board of regents of The Texas A&M 
University System may charge students enrolled at Prairie View A&M 
University an intercollegiate athletics fee not to exceed $10 per 
semester credit hour if the fee is approved by a vote of students 
enrolled at the university.
	(b)  A fee under this section may not exceed the amount 
payable for 13 semester credit hours, regardless of the number of 
semester credit hours taken by the student.
	(c)  The fee may not be initially assessed unless approved by 
a majority vote of the students participating in a general student 
election held for that purpose.
	(d)  The fee authorized by this section may be increased from 
year to year by not more than five percent per semester credit hour 
if such increase is approved by the legislative body of the student
government at the university.  Any increase from year to year that 
exceeds five percent must be approved by a majority vote of students 
participating in a general student election held for that purpose.
	(e)  The fee authorized by this section is not counted in 
determining the maximum student services fee which may be charged 
under Section 54.503.
	SECTION 2.  This Act applies beginning with the 2003 fall 
semester.          
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
