A BILL TO BE ENTITLED
AN ACT
relating to collection and use of information in connection with licensing regarding a retail installment transaction involving a motor vehicle. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 348, Finance Code, is amended by adding Section 348.013 to read as follows: Sec. 348.013. CONFIDENTIALITY OF CERTAIN INFORMATION. (a) Except as provided by Subsection (b), information contained in an application for a license under Section 348.502 or other information relating to a license holder or license applicant that is on file with the commissioner is confidential and not open to public inspection. (b) Information made confidential by this section may be disclosed in a judicial or administrative proceeding pursuant to a lawful subpoena. SECTION 2. Subchapter F, Chapter 348, Finance Code, is amended by adding Section 348.5045 to read as follows: Sec. 348.5045. FINGERPRINTS. Notwithstanding any other law, the commissioner may not: (1) require a person to provide the person's fingerprints if the person is not regularly engaged in a business of an applicant or license holder that is regulated or to be regulated under this chapter; or (2) suspend or revoke a license under Section 348.508 or deny an application for a license under Section 348.504 because the applicant or license holder did not provide the fingerprints of a person who is not regularly engaged in a business of the applicant or license holder that is regulated or to be regulated under this chapter. SECTION 3. This Act takes effect September 1, 2003.
