A BILL TO BE ENTITLED
AN ACT
relating to the use of site-specific information by a groundwater
conservation district to develop its management plan.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 36.1071, Water Code, is amended by
amending Subsection (h) and adding Subsection (i) to read as
follows:
(h) In developing its management plan, the district shall
use the groundwater availability modeling information provided by
the executive administrator in conjunction with any available
site-specific information provided by the district [and acceptable
to the executive administrator].
(i) If, on review of the management plan, the executive
administrator determines that any of the site-specific information
provided by the district under Subsection (h) is unreliable, the
executive administrator shall notify the district. The district
shall consider any comments received from the executive
administrator and may amend the management plan accordingly.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
