A BILL TO BE ENTITLED
AN ACT
relating to the Texas Peace Officers' Memorial in the Capitol Complex. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subtitle A, Title 11, Government Code, is amended by adding Chapter 3103 to read as follows:
CHAPTER 3103. TEXAS PEACE OFFICERS' MEMORIAL
Sec. 3103.001. PURPOSE OF MEMORIAL. The Texas Peace Officers' Memorial is a monument erected on the grounds of the Capitol Complex to recognize and honor the ultimate sacrifice made by law enforcement and corrections officers in this state who were killed in the line of duty. Sec. 3103.002. DEFINITIONS. In this chapter: (1) "Commission" means the Commission on Law Enforcement Officer Standards and Education. (2) "Memorial" means the Texas Peace Officers' Memorial. Sec. 3103.003. ELIGIBILITY FOR MEMORIAL. A person is eligible to have the person's name on the memorial if the person was killed in the line of duty and was: (1) a law enforcement officer or peace officer for this state or a political subdivision of this state under Article 2.12, Code of Criminal Procedure, or other law; or (2) a corrections or detention officer or county or municipal jailer employed or appointed by a municipal, county, or state penal institution in this state. Sec. 3103.004. COMMISSION POWERS AND DUTIES. (a) The commission is responsible for the maintenance of the memorial. The commission shall: (1) establish a maintenance schedule for the memorial; (2) in conjunction with the State Preservation Board, select persons to maintain the memorial; (3) establish and maintain historical and archival records about persons whose names appear on the memorial that must be accessible to the family members of those persons and to researchers; and (4) adopt rules and establish procedures for adding names to the memorial in accordance with Section 3103.003. (b) The commission may: (1) accept money from a private or public source for the continued maintenance of the memorial; and (2) contract with public or private entities to: (A) establish and maintain historical and archival records; (B) store records in a place accessible to the public; and (C) facilitate research. Sec. 3103.005. ACCOUNT. (a) Money contributed to the state for a purpose related to the memorial shall be deposited in the state treasury to the credit of a separate interest-bearing account in the general revenue fund established for the memorial. (b) Notwithstanding other law, income from investments of money in the account shall be deposited to the credit of the account. (c) Money in the account may only be used for the purposes prescribed by this chapter. SECTION 2. Subchapter Z, Chapter 1701, Occupations Code, is repealed. SECTION 3. (a) The account referred to in Section 3103.005, Government Code, as added by this Act, is the same account that was previously created under Section 1701.963, Occupations Code. The repeal of Section 1701.963 by this Act does not abolish the account. (b) The advisory committee created under Subchapter Z, Chapter 1701, Occupations Code, which is repealed by this Act, is abolished. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
