A BILL TO BE ENTITLED
AN ACT
relating to the location of a crematory. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Sections 711.006(a) and (b), Health and Safety Code, are amended to read as follows: (a) A crematory may be constructed, established, or maintained only in: (1) a burial park having a columbarium, plot, or mausoleum equipped for the interment of cremated remains; or (2) another location operated by a licensed funeral establishment as authorized by rules adopted by the Texas Funeral Service Commission. (b) The crematory may be in: (1) the same fireproof structure as the columbarium, plot, or mausoleum, or in a separate fireproof building in the same burial park as the columbarium, plot, or mausoleum; or (2) a fireproof building maintained by a licensed funeral establishment as authorized by rules adopted by the Texas Funeral Service Commission. SECTION 2. No later than January 1, 2004, the Texas Funeral Service Commission shall adopt rules required to implement Section 711.006, Health and Safety Code, as amended by this Act. SECTION 3. This Act takes effect September 1, 2003.
