A BILL TO BE ENTITLED
AN ACT
relating to the movement of vehicles transporting ocean cargo shipping containers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 623, Transportation Code, is amended by adding Subchapter L to read as follows:
SUBCHAPTER L. OCEAN CARGO SHIPPING CONTAINERS
Sec. 623.231. DEFINITION. In this subchapter, "ocean cargo shipping container" means an enclosed, standardized, reusable container that: (1) is used to pack, ship, move, or transport freight articles, goods, or commodities; (2) is designed to be carried on a trailer and loaded onto a vessel for ocean-borne transportation; and (3) exceeds the weight limitations of this chapter. Sec. 623.232. PERMIT. The department may issue an annual permit for the movement of ocean cargo shipping containers if: (1) the combination of vehicles transporting the containers has: (A) a tandem axle weight of not more than 40,000 pounds; (B) a single axle weight of not more than 20,000 pounds; and (C) a gross weight of not more than 90,000 pounds; and (2) the proposed movement of the container does not exceed 75 miles from the point of loading to a container port or intermodal rail yard in this state. Sec. 623.233. PERMIT FEE. The amount of the fee for an annual permit issued under Section 623.232 is equal to the amount of a fee imposed in connection with a permit issued under Subchapter B. SECTION 2. This Act takes effect September 1, 2003.
