A BILL TO BE ENTITLED

AN ACT

relating to the scheduling of spring break in public school 
districts.      
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter C, Chapter 25, Education Code, is 
amended by adding Section 25.0812 to read as follows:
	Sec. 25.0812.  SPRING BREAK SCHEDULING.  (a)   Except as 
authorized under Subsection (b), a school district may not schedule 
a spring break vacation period that includes the second Tuesday in 
March of an even-numbered year.
	(b)  The commissioner may approve a spring break vacation 
period that includes the second Tuesday in March of an 
even-numbered year if disaster, flood, extreme weather conditions, 
fuel curtailment, or another calamity occurs that makes it 
advisable for a school district to reschedule the period to that 
time.
	SECTION 2.  (a)  This Act takes effect immediately if it 
receives a vote of two-thirds of all the members elected to each 
house, as provided by Section 39, Article III, Texas Constitution.  
If this Act does not receive the vote necessary for immediate 
effect, this Act takes effect September 1, 2003.
	(b)  This Act applies beginning with the 2003-2004 school 
year.
