A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Public Utility Commission of Texas
to resolve certain disputes relating to the rates and terms of
transmission service.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. RESOLUTION OF CERTAIN UTILITY DISPUTES.
(a) The Public Utility Commission may resolve disputes relating to
the rates and terms of transmission services within the Electric
Reliability Council of Texas for service provided before January 1,
2000. The Commission shall initiate appropriate proceedings to
resolve any such dispute at the request of a party to the dispute.
(b) If the commission resolves a dispute involving
municipal utilities and a municipal power authority that is also
the subject of an action or proceeding pending before the Federal
Energy Regulatory Commission on the effective date of this Act, the
commission's resolution of the dispute is not subject to judicial
review by a court of this state and shall be a final statement of the
rate methodology for transmission service among the parties to the
dispute.
SECTION 2. This Act takes effect on September 1, 2003.
