A BILL TO BE ENTITLED
AN ACT
relating to the payment of court costs in an asset forfeiture case. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 59.05, Code of Criminal Procedure, is amended by adding Subsection (g) to read as follows: (g) Notwithstanding Subsection (e), if the clerk of the court in which a notice of seizure and intended forfeiture is filed determines that contraband subject to forfeiture in the proceeding has a value that exceeds $2,500, the clerk may require the attorney representing the state to pay court costs at the time of the filing of the notice. SECTION 2. This Act takes effect September 1, 2003.
