A BILL TO BE ENTITLED
AN ACT
relating to a promotion and development fund of a sports and
community venue district located in a populous county.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 335, Local Government Code, is hereby
amended by adding a new Section 335.0721, as follows:
Sec. 335.0721. PROMOTION AND DEVELOPMENT FUND. (a) A
district located in whole or in part in a county with a population
of 3.3 million or more may set aside out of revenues derived from
any tax imposed pursuant to Section 335.071(e) a promotion and
development fund of not more than ____ percent of such revenues in
each calendar year.
(b) Money in the promotion and development fund may be spent
by the district or as the district may direct to pay any expenses
connected with:
(1) any event, activity or project that the board of
the district reasonably determines will have a likelihood of
generating revenues from any tax imposed by the district pursuant
to Section 335.071(e) or any other method of financing of the
district, and that the board of directors of the district
determines by resolution: (A) will contribute to the economic,
cultural, or recreational development or well-being of the
residents of the district; (B) furthers the general welfare of the
district and its projects and facilities, or (C) otherwise
promotes or encourages sports and community activities or other
purposes for which the district was formed; or
(2) any activity or matter incidental to the
advertising or marketing of any venue project of the district or its
operations.
(c) The promotion and development fund shall be under the
exclusive control of the board of directors of the district, and the
board shall have full responsibility for approving and safeguarding
the expenditure of money from the fund.
(d) The promotion and development fund may not be used for
any event, activity, project or other matter not related to the
purposes for which the district was formed or the types of projects
described in Section 335.001(6), except that the promotion and
development fund may be used for an alternative project as that term
is defined in Section 335.076(b).
(e) The promotion and development fund shall be audited at
least annually and the results of such audit shall be reported to
the board and the governing bodies of any municipality or county
that created the district.
SECTION 2. The importance of this legislation and the
crowded condition of the calendars of both houses create an
emergency and an imperative public necessity that the
constitutional rule requiring bills to be read on three several
days in each house be suspended, and this rule is hereby suspended.
