A BILL TO BE ENTITLED
AN ACT
relating to the creation of a grocery certificate for the sale of alcoholic beverages. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 25, Alcoholic Beverage Code, is amended by adding Section 25.14 as follows: Sec. 25.14. GROCERY CERTIFICATE. (a) A holder of a Wine and Beer Retailer's permit may be issued a grocery certificate by the commission if the premises for which the certificate is issued exceed 15,000 square feet, have three or more checkout counters and provide retail food sales. (b) The fee for a grocery certificate shall be set at a level sufficient to recover the cost of issuing the certificate and administering this section. (c) A certificate expires on the expiration of the primary permit. SECTION 2. Chapter 26, Alcoholic Beverage Code, is amended by adding Section 26.08 as follows: Sec. 26.08. Grocery Certificate. (a) A holder of a Wine and Beer Retailer's Off-Premise permit may be issued a grocery certificate by the commission if the premises for which the certificate is issued exceed 15,000 square feet, have three or more checkout counters and provide retail food sales. (b) The fee for a grocery certificate shall be set at a level sufficient to recover the cost of issuing the certificate and administering this section. (c) A certificate expires on the expiration of the primary permit. SECTION 3. Chapter 69, Alcoholic Beverage Code, is amended by adding Section 69.17 as follows: Sec. 69.17. GROCERY CERTIFICATE. (a) A holder of a Retail Dealer's On-Premise license may be issued a grocery certificate by the commission if the premises for which the certificate is issued exceed 15,000 square feet, have three or more checkout counters and provide retail food sales. (b) The fee for a grocery certificate shall be set at a level sufficient to recover the cost of issuing the certificate and administering this section. (c) A certificate expires on the expiration of the primary license. SECTION 4. Chapter 71, Alcoholic Beverage Code, is amended by adding Section 71.11 as follows: Sec. 71.11. GROCERY CERTIFICATE. (a) A holder of a Retail Dealer's Off-Premise license may be issued a grocery certificate by the commission if the premises for which the certificate is issued exceed 15,000 square feet, have three or more checkout counters and provide retail food sales. (b) The fee for a grocery certificate shall be set at a level sufficient to recover the cost of issuing the certificate and administering this section. (c) A certificate expires on the expiration of the primary license. SECTION 5. This Act takes effect September 1, 2003.
