A BILL TO BE ENTITLED

AN ACT

relating to the creation of an offense intended to increase firearm 
safety. 
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.   Chapter 46, Penal Code, is amended by adding 
Section 46.061 to read as follows:
	Sec. 46.061.  TRANSFER OF FIREARM BY DEALER. (a)  In this 
section, "dealer of firearms" means a person licensed as a firearms 
dealer under 18 U.S.C. Chapter 44.
	(b)  A dealer of firearms commits an offense if the dealer 
sells, rents, leases, loans, or gives a firearm to a person and does 
not sell, rent, lease, loan, or give to the person a trigger lock or 
similar device intended to prevent the accidental discharge of the 
firearm.
	(c)  An offense under this section is a Class C misdemeanor.            
	SECTION 2.   This Act takes effect September 1, 2003.
