A BILL TO BE ENTITLED
AN ACT
relating to the members of the boards of regents of The University
of Texas System and The Texas A&M University System.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 65.12, Education Code, is amended to
read as follows:
Sec. 65.12. QUALIFICATIONS; TERMS. (a) Each member of the
board must [shall] be a qualified voter[; and the members shall be
selected from different portions of the state]. The members hold
office for staggered terms of six years, with the terms of three
members expiring February 1 of each odd-numbered year [years].
(b) The governor shall appoint three members of the board to
represent the state at large and one member to represent each of the
regions described by Section 65.121.
(c) A member of the board appointed under Subsection (b) to
represent a region must have resided in the region for the two years
preceding the date of the member's appointment and must continue to
reside in the region during the member's term.
SECTION 2. Subchapter B, Chapter 65, Education Code, is
amended by adding Section 65.121 to read as follows:
Sec. 65.121. BOARD MEMBER REGIONS. (a) Region 1 is
composed of Andrews, Archer, Armstrong, Bailey, Bandera, Baylor,
Borden, Bosque, Brewster, Briscoe, Brown, Callahan, Carson,
Castro, Childress, Clay, Cochran, Coke, Coleman, Collingsworth,
Comanche, Concho, Cottle, Crane, Crockett, Crosby, Culberson,
Dallam, Dawson, Deaf Smith, Dickens, Donley, Eastland, Ector,
Edwards, El Paso, Erath, Fisher, Floyd, Foard, Gaines, Garza,
Gillespie, Glasscock, Gray, Hale, Hall, Hamilton, Hansford,
Hardeman, Hartley, Haskell, Hemphill, Hockley, Hood, Howard,
Hudspeth, Hutchinson, Irion, Jack, Jeff Davis, Jones, Kent, Kerr,
Kimble, King, Knox, Lamb, Lipscomb, Llano, Loving, Lubbock, Lynn,
McCulloch, Martin, Mason, Menard, Midland, Mills, Mitchell,

(b) Region 2 is composed of Collin, Dallas, Denton, and
Tarrant counties.
(c) Region 3 is composed of Anderson, Angelina, Austin,
Bowie, Brazos, Burleson, Camp, Cass, Chambers, Cherokee, Colorado,
Cooke, Delta, Ellis, Fannin, Franklin, Freestone, Grayson, Gregg,
Grimes, Hardin, Harrison, Henderson, Hill, Hopkins, Houston, Hunt,
Jasper, Jefferson, Johnson, Kaufman, Lamar, Leon, Liberty,
Limestone, Madison, Marion, Montgomery, Morris, Nacogdoches,
Navarro, Newton, Orange, Panola, Polk, Rains, Red River, Robertson,
Rockwall, Rusk, Sabine, San Augustine, San Jacinto, Shelby, Smith,
Titus, Trinity, Tyler, Upshur, Van Zandt, Walker, Waller,
Washington, and Wood counties.
(d) Region 4 is composed of Brazoria, Fort Bend, Galveston,
and Harris counties.
(e) Region 5 is composed of Aransas, Atascosa, Bee, Brooks,
Calhoun, Cameron, DeWitt, Dimmit, Duval, Frio, Goliad, Gonzales,
Hidalgo, Jackson, Jim Hogg, Jim Wells, Karnes, Kenedy, Kinney,
Kleberg, La Salle, Lavaca, Live Oak, McMullen, Matagorda, Maverick,
Medina, Nueces, Refugio, San Patricio, Starr, Uvalde, Val Verde,
Victoria, Webb, Wharton, Willacy, Wilson, Zapata, and Zavala
counties.
(f) Region 6 is composed of Bastrop, Bell, Bexar, Blanco,
Burnet, Caldwell, Comal, Coryell, Falls, Fayette, Guadalupe, Hays,
Kendall, Lampasas, Lee, McLennan, Milam, Travis, and Williamson
counties.

read as follows:

SECTION 5. (a) The changes in law made by this Act in the
qualifications of members of the board of regents of The University
of Texas System and the board of regents of The Texas A&M University
System do not affect the entitlement of a member serving on either
board immediately before the effective date of this Act to continue
to serve for the remainder of the member's term. The changes in law
apply only to a member appointed on or after the effective date of
this Act. This Act does not prohibit a person who is a member of
either board on the effective date of this Act from being
reappointed to the board if the person has the qualifications
required for a member under Section 65.12 or 85.12, Education Code,
as applicable, as amended by this Act.
(b) As the terms of members of the boards of regents expire
or as vacancies occur on the boards, the governor shall make
appointments to each board to achieve, as soon as possible, the
applicable membership plan prescribed by Section 65.12 or 85.12,
Education Code, as amended by this Act.
SECTION 6. This Act takes effect September 1, 2003.
