A BILL TO BE ENTITLED

AN ACT

relating to breast reconstruction services for recipients of 
medical assistance.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 32, Human Resources Code, 
is amended by adding Section 32.059 to read as follows:
	Sec. 32.059.  BREAST RECONSTRUCTION SERVICES.  (a)  If the 
department provides to a recipient of medical assistance under this 
chapter necessary mastectomy surgery and related services, the 
department shall also provide to the recipient:
		(1)  reconstruction of the breast on which the 
mastectomy has been performed;
		(2)  surgery and reconstruction of the other breast to 
achieve a symmetrical appearance; and
		(3)  prostheses and treatment of physical 
complications, including lymphedemas, at all stages of mastectomy.
	(b)  The services required by this section shall be provided 
in a manner determined to be appropriate by the attending physician 
and the recipient.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
