A BILL TO BE ENTITLED
AN ACT
relating to the composition, appointment, and reconstitution of the board of directors of the Brazos River Authority. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 6, Chapter 13, Special Laws, Acts of the 41st Legislature, 2nd Called Session, 1929, is amended to read as follows: Sec. 6. The Board of Directors of the Brazos River Authority shall have nine [twenty-one (21)] members. Members of the Board and their successors shall serve for a term of six [(6)] years and until their successors are designated and qualified. On February 1, of each odd-numbered year, the terms of three [seven (7)] members of the Board expire. [The persons serving on the Board on the effective date of this amendment shall continue to serve for their unexpired terms.] The Governor shall appoint three [seven (7)] persons each biennium with the advice and consent of the Senate to serve on the Board of Directors of the Brazos River Authority and not more than 60 [sixty (60)] days thereafter each of said Directors shall take and subscribe to an oath of office, similar in character to the oaths administered to County Commissioners and shall execute bond in the sum of $5,000 [Five Thousand ($5,000.00) Dollars] each, payable to the Authority, the premium on said bonds to be paid by the Authority which bonds after being recorded in the official bond records of the county in which the Authority maintains its office shall be deposited with a depository selected and approved for the deposit of the funds of the Authority. All vacancies occurring in the Board of Directors shall be filled by appointment of the Governor with the advice and consent of the Senate. Five [Seven (7)] members shall constitute a quorum to transact business. No more than two [(2)] of said Directors shall be appointed who reside in the same county at the time of their appointment. The Governor shall designate a member of the Board of Directors as the presiding officer of the Board to serve in that capacity at the pleasure of the Governor. The Board shall elect one [(1)] of their number as [Chairman, one (1)] Vice-Chairman and [,] one as [(1)] Secretary and appoint a Treasurer who shall furnish a bond in the sum of 75 percent [seventy-five (75%) per cent] of the amount of money estimated to be on hand during the year, in no event to be more than $100,000 [One Hundred Thousand ($100,000.00) Dollars]. SECTION 2. As soon as practicable on or after the effective date of this Act, the governor shall appoint nine directors as provided by Section 6, Chapter 13, Special Laws, Acts of the 41st Legislature, 2nd Called Session, 1929, as amended by this Act. The governor shall appoint three of the directors to terms expiring on February 1, 2005, three to terms expiring on February 1, 2007, and three to terms expiring on February 1, 2009. The position of a member of the Brazos River Authority board of directors serving immediately before the effective date of this Act is abolished at the time five or more of the newly appointed directors qualify for office. Until the abolition of members' positions occurs under this section, the members serving immediately before the effective date of this Act have the same powers and duties that the members had immediately before that date and the board of directors continues to be composed in the way it was composed before that date, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2003.
