A BILL TO BE ENTITLED
AN ACT
relating to the County Court at Law of Aransas County.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subsections (b) and (c), Section 25.0062,
Government Code, are amended to read as follows:
(b) The district clerk serves as clerk of a county court at
law in felony cases and family law cases and proceedings [matters of
concurrent jurisdiction with the district court], and the county
clerk serves as clerk of a county court at law in all other cases.
The district clerk shall establish a separate docket for a county
court at law. The commissioners court shall provide the deputy
clerks, bailiffs, and other personnel necessary to operate a county
court at law.
(c) The jury is composed of six [12] members unless the
constitution or other law requires a 12–member jury [in all matters
of concurrent jurisdiction with the district court and six members
in misdemeanor criminal cases and all other cases].
SECTION 2. Subsection (a), Section 152.0101, Human
Resources Code, is amended to read as follows:
(a) The juvenile board of Aransas County is composed of the
county judge, [and] the district judges in Aransas County, and the
judge of the county court at law.
SECTION 3. The change in law made by this Act applies only
to a case filed or proceeding commenced on or after the effective
date of this Act. A case filed or proceeding commenced before the
effective date of this Act is governed by the law in effect on the
date the case was filed or the proceeding was commenced, and the
former law is continued in effect for that purpose.
SECTION 4. This Act takes effect September 1, 2003.
