AN ACT
relating to the name of Southwest Texas State University.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading of Subchapter C, Chapter 96,
Education Code, is amended to read as follows:
SUBCHAPTER C. [SOUTHWEST] TEXAS STATE UNIVERSITY--SAN MARCOS
SECTION 2. Section 96.41, Education Code, is amended to
read as follows:
Sec. 96.41. [SOUTHWEST] TEXAS STATE UNIVERSITY--SAN
MARCOS. [Southwest] Texas State University--San Marcos is a
coeducational institution of higher education located in the city
of San Marcos. It is under the management and control of the Board
of Regents, Texas State University System.
SECTION 3. The heading of Section 54.511, Education Code,
is amended to read as follows:
Sec. 54.511. STUDENT FEES FOR BUS SERVICE; [SOUTHWEST]
TEXAS STATE UNIVERSITY--SAN MARCOS.
SECTION 4. Subsection (a), Section 54.511, Education Code,
is amended to read as follows:
(a) The board of regents of the Texas State University
System may charge each student enrolled at [Southwest] Texas State
University--San Marcos a fee initially set at $10 per semester or $5
per six-week summer term to be used to finance bus service for
students attending the institution.
SECTION 5. Subsection (a), Section 55.1724, Education Code,
is amended to read as follows:
(a) In addition to the other authority granted by this
subchapter, the board of regents of the Texas State University
System may acquire, purchase, construct, improve, renovate,
enlarge, or equip property, buildings, structures, facilities,
roads, or related infrastructure for the following institutions to
be financed by the issuance of bonds in accordance with this
subchapter and in accordance with a systemwide revenue financing
program adopted by the board in aggregate principal amounts not to
exceed the following:
(1) Angelo State University, $20 million;
(2) Lamar University--Beaumont, $8 million;
(3) Lamar Institute of Technology, $2 million;
(4) Lamar State College--Orange, $3.5 million;
(5) Lamar State College--Port Arthur, $2.75 million;
(6) Sam Houston State University, $7.5 million;
(7) [Southwest] Texas State University--San Marcos,
$19.7 million; and
(8) Sul Ross State University, $17.5 million.
SECTION 6. Subsection (a), Section 55.1734, Education Code,
is amended to read as follows:
(a) In addition to the other authority granted by this
subchapter, the board of regents of the Texas State University
System may issue in accordance with this subchapter and in
accordance with a systemwide revenue financing program adopted by
the board bonds for the following institutions not to exceed the
following aggregate principal amounts to finance projects
specified as follows:
(1) Angelo State University, $16,917,550 to expand and
renovate institutional facilities;
(2) Lamar University--Beaumont, $21,792,096 to
renovate and repair campus buildings;
(3) Lamar Institute of Technology, $5,301,960 to
renovate Gentry Hall and convert it to classroom and laboratory
use;
(4) Lamar State College--Orange, $2,125,000 for
campus landscaping, renovation of the old library for physical
plant purposes, renovation of the Main Building and Electronics
Commerce Resource Center, and demolition of the old physical plant
building;
(5) Lamar State College--Port Arthur, $7,650,000 to
construct a performing arts and classroom building and to expand
the Gates Memorial Library and develop an adjacent plaza;
(6) Sam Houston State University, $18 million to
renovate and expand the Farrington Building;
(7) [Southwest] Texas State University--San Marcos,
$18,436,500 to construct a business building; and
(8) Sul Ross State University, $15,175,000 to renovate
and expand the range animal science facility and science building
annex and to carry out other building renovations.
SECTION 7. Subdivision (3), Section 61.003, Education Code,
is amended to read as follows:
(3) "General academic teaching institution" means The
University of Texas at Austin; The University of Texas at El Paso;
The University of Texas of the Permian Basin; The University of
Texas at Dallas; The University of Texas at San Antonio; Texas A&M
University, Main University; The University of Texas at Arlington;
Tarleton State University; Prairie View A&M University; Texas
Maritime Academy; Texas Tech University; University of North Texas;
Lamar University; Lamar State College--Orange; Lamar State
College--Port Arthur; Texas A&M University--Kingsville; Texas A&M
University--Corpus Christi; Texas Woman's University; Texas
Southern University; Midwestern State University; University of
Houston; University of Texas--Pan American; The University of Texas
at Brownsville; Texas A&M University--Commerce; Sam Houston State
University; [Southwest] Texas State University--San Marcos; West
Texas A&M University; Stephen F. Austin State University; Sul Ross
State University; Angelo State University; The University of Texas
at Tyler; and any other college, university, or institution so
classified as provided in this chapter or created and so
classified, expressly or impliedly, by law.
SECTION 8. Subsection (a), Section 62.021, Education Code,
is amended to read as follows:
(a) Each fiscal year, an eligible institution is entitled to
receive an amount allocated in accordance with this section from
funds appropriated by Section 17(a), Article VII, Texas
Constitution. The comptroller shall distribute funds allocated
under this subsection only on presentation of a claim and issuance
of a warrant in accordance with Section 403.071, Government Code.
The comptroller may not issue a warrant from any funds allocated
under this subsection before the delivery of goods or services
described in Section 17, Article VII, Texas Constitution, except
for the payment of principal or interest on bonds or notes or for a
payment for a book or other published library material as
authorized by Section 2155.386, Government Code. The allocation of
funds under this subsection is made in accordance with an equitable
formula consisting of the following elements: space deficit,
facilities condition, institutional complexity, separate
allocations for medical units and the Texas State Technical College
System, and an additional allocation for Texas Southern University
for compliance with the Texas Desegregation Plan. The amounts
allocated by the formula are as follows:
$ 5,256,817 Texas A&M University--Commerce, including an
allocation of $1,027,070 to Texas A&M University--Texarkana;
$ 8,818,023 Lamar University, including an allocation of
$491,946 to Lamar Institute of Technology, an allocation of
$743,967 to Lamar University at Orange and an allocation of
$2,336,605 to Lamar University at Port Arthur;
$ 3,007,669 Midwestern State University;
$18,021,033 University of North Texas;
$ 7,131,692 The University of Texas--Pan American, including
an allocation of $1,050,580 to The University of Texas at
Brownsville;
$ 6,633,109 Stephen F. Austin State University;
$ 3,640,000 University of North Texas Health Science Center
at Fort Worth;
$26,132,524 Texas State University System Administration and
the following component institutions, including an allocation of
$3,887,211 to Angelo State University; an allocation of $5,864,608
to Sam Houston State University; an allocation of $14,479,112 to
[Southwest] Texas State University--San Marcos; an allocation of
$1,635,271 to Sul Ross State University; and an allocation of
$266,322 to Sul Ross State University-Rio Grande College;
$ 7,191,493 Texas Southern University (includes allocation
of $1,000,000 for compliance with Texas Desegregation Plan);
$20,961,881 Texas Tech University;
$ 7,735,000 Texas Tech University Health Sciences Center;
$ 6,974,897 Texas Woman's University;
$36,952,989 University of Houston System Administration and
the following component institutions, including an allocation of
$25,986,116 to the University of Houston; an allocation of
$1,659,449 to the University of Houston--Victoria; an allocation of
$3,853,447 to the University of Houston--Clear Lake; and an
allocation of $5,453,977 to the University of Houston--Downtown;
$12,692,873 The following components of The Texas A&M
University System, including an allocation of $3,687,722 to Texas
A&M University--Corpus Christi; an allocation of $1,778,155 to
Texas A&M International University; an allocation of $3,555,651 to
Texas A&M University--Kingsville; and an allocation of $3,671,345
to West Texas A&M University; and
$ 3,850,000 Texas State Technical College System
Administration and the following component campuses, but not its
extension centers or programs: Texas State Technical
College-Harlingen; Texas State Technical College--Marshall; Texas
State Technical College-Sweetwater; Texas State Technical
College--Waco.
SECTION 9. Subsection (b), Section 62.055, Education Code,
is amended to read as follows:
(b) Subsection (a) does not apply to the distribution of
money from the Texas excellence fund for the state fiscal biennium
ending August 31, 2003. Notwithstanding any other provision of
this subchapter, for each fiscal year of the state fiscal biennium
ending August 31, 2003, the comptroller shall distribute the money
in the fund among the following general academic teaching
institutions as follows: FY2002 FY2003
University of Houston $5,533,185 $6,651,584
Texas Tech University $4,769,654 $5,733,723
University of North Texas $1,966,761 $2,364,293
University of Houston-Clear Lake $633,661 $761,740
Southwest] Texas State University--San Marcos,
may annually produce maps of the state that include information
regarding crime statistics correlated with the various regions of
the state.
SECTION 11. (a) The name of Southwest Texas State
University is changed to Texas State University--San Marcos.
(b) A reference in law to Southwest Texas State University
means Texas State University--San Marcos.
(c) An appropriation for the use and benefit of Southwest
Texas State University is available for the use and benefit of Texas
State University--San Marcos.
(d) The board of regents of the Texas State University
System and Southwest Texas State University shall ensure that the
change of the name made by this Act is implemented with as little
unnecessary cost as possible. The university shall, to the maximum
extent practicable, use all stationery and other consumable
supplies that are printed with the institution's former name and
are in its possession on the effective date of this Act.
SECTION 12. This Act takes effect September 1, 2003.
