IN RE:	HB11 by Keel (Relating to the offense of terroristic threat and to the punishment as a capital offense of murder occurring during the commission or attempted commission of terroristic threat.), Conference Committee Report

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code by making the murder occurring during the commission of the offense of terroristic threat punishable as a capital offense.  The bill would also amend the Penal Code by making the offense of terroristic threat punishable as a felony of the third degree if the act is committed with intent to: a) place the public or a substantial group of the public in fear of serious bodily injury; or b) influence the conduct or activities of a branch or agency of the federal government, the state, or a political subdivision.  The offense of terroristic threat is currently punishable as a Class A misdemeanor or a felony of the third degree.   

 

The Texas Department of Criminal Justice and the Department of Public Safety have determined that the cost of implementing the provisions of this bill would not be significant. 

Local Government Impact

No fiscal implication to units of local government is anticipated.
