FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 8, 2003

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB90 by McClendon (Relating to the release on bail of a person arrested for an offense under Chapter 49, Penal Code.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure by requiring before release on bail persons arrested for intoxication and alcoholic beverage offenses, the law enforcement agency holding the person to make a determination that the person is no longer intoxicated.  It is assumed that this bill would not significantly affect the operations of state government.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
