No significant fiscal implication to the State is anticipated.

In addition to the costs on conviction imposed by Article 102.018 and Article 102.016, under the Code of Criminal Procedure, this bill would require a person convicted of an offense under Chapter 49, Penal Code, to pay $100 upon conviction of the offense.  Funds generated as a result of such convictions may be used only for the purchase of law enforcement equipment that the municipality or county determines will assist in the enforcement and prevention of alcohol-related offenses.


Local Government Impact

The Office of Court Administration reports that in fiscal year 2002, there were 7,811 felony convictions and 72,171 misdemeanor convictions for driving under the influence (DUI).  If the rate of convictions in fiscal year 2002 remains stable in subsequent years, implementing the bill could result in as much as $7,998,200 in additional revenue for Texas municipalities and counties.  Several factors would determine a municipality's or county's actual level of revenue, including the number of arrests and convictions and the offender's ability to pay.
