LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 29, 2003

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB325 by McCall (Relating to the punishment for the offense of failure to identify.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code relating to the offense of failure to identify.  The offense of failure to identify is currently punishable as a Class C misdemeanor, unless the offender was a fugitive from justice at the time of the offense, in which case the offense is punishable as a Class B misdemeanor.  The bill would also specify the offense for which an actor would be prosecuted if conduct constitutes an offense of failure to identify and also misrepresentation of age by a minor.  The bill would also amend the Penal Code by adding the offense of failure to report a felony that would be punishable as a Class A misdemeanor.  It is assumed that this bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
