LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 10, 2003

TO:
Honorable Joe Driver, Chair, House Committee on Law Enforcement

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB325 by McCall (Relating to the punishment for the offense of failure to identify.), Committee Report 1st House, As Amended

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code by enhancing the punishment for the offense of failure to identify to a Class B misdemeanor or a Class A misdemeanor, depending on the conditions of the offense.  The offense of failure to identify is currently punishable as a Class C misdemeanor, unless the offender was a fugitive from justice at the time of the offense, in which case the offense is punishable as a Class B misdemeanor.  It is assumed that this bill would not significantly affect the fiscal operations of state government.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
