LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 8, 2003

TO:
Honorable Robert Duncan, Chair, Senate Committee on Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB374 by Dutton (Relating to the right of certain persons to discipline a child.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would provide that a parent or other person having the duty of control and reasonable discipline of a child may use corporeal punishment for the reasonable discipline of the child. The Department of Protective and Regulatory Services indicates that the proposed language may impact daycare providers and that, as a result, the standards to license these providers may need to be amended. Such a rule change, however, could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
