The bill would amend the Business & Commerce Code by creating the offense of ticket scalping which would prevent the resell or offer to resell a ticket to an event for a price that is more than $5 over the price authorized to be offered to the public by the event sponsor. Punishment for the offense would range from a Class C misdemeanor to a state jail felony depending on the number of tickets sold or offered for sale.
It is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies nor on the demand for resources and services of those agencies.
