HB547 by Wohlgemuth (Relating to the distance between certain pits that are part of quarrying operations and adjacent property. ), Conference Committee Report

No significant fiscal implication to the State is anticipated.


The bill would amend the Natural Resources Code to apply a 50-foot setback from private property lines for quarries and pits currently applicable only in counties with a population between 400,000 and all active pit operations in the state, increasing the number of pits and quarries within the Railroad Commission's jurisdiction. The bill would also provide specific exceptions to the 50 foot requirement. It is expected that any additional costs resulting from additional disputes over property lines and the location of pits as a result of the bill's passage could be absorbed within existing agency resources.

The bill would take effect September 1, 2003.
