HB555 by Chisum (Relating to notice requirements for certain portable facilities under the Clean Air Act. ), Conference Committee Report

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to exclude portable facilities from public notice requirements if the facility relocates to a site where a portable facility permitted by the commission has been located at any time during the previous two years.  The bill would also require the measurement of distances to determine compliance with any location or distance restriction required by the bill be taken toward structures in use as of the date that the application is filed with the Texas Commission on Environmental Quality for any permit application under Health and Safety Code, Section 382.056.

 

Based on the prior analyses of the Texas Department of Transportation and the Texas Commission on Environmental Quality, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. 

 

The bill would take effect immediately upon receiving a two-thirds majority vote in both houses; otherwise, the bill would take effect September 1, 2003.

No significant fiscal implication to units of local government is anticipated.
