LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 28, 2003

TO:
Honorable Joe Driver, Chair, House Committee on Law Enforcement

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB565 by Haggerty (Relating to the punishment for the offenses of assault and aggravated assault committed against a commissioned security officer.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code by making the offense of assault punishable as a felony of the third degree if the offense is committed against a commissioned security officer while the officer is performing a duty as a security officer.  The bill would also make the offense of aggravated assault committed against a commissioned security officer while the officer is performing a duty as a security officer punishable as a felony of the first degree.  Since the punishment enhancement provisions of the bill would only apply to specific offenses committed against a commissioned security officer while the officer is performing a duty as a security officer, the fiscal impact is not anticipated to be significant.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
