No significant fiscal implication to the State is anticipated.

The bill would amend Title 7, Local Government Code, to authorize home-rule municipalities to adopt an ordinance prohibiting criminal trespass and would set the penalty as a Class C misdemeanor. An offense would apply under the statute if the violation took place within the limits of the municipality. A person prosecuted under the city ordinance could not be prosecuted for the same conduct under Section 30.05 of the Penal Code. The bill would take effect immediately if it were to receive two-thirds vote in both houses; otherwise, it would take effect September 1, 2003.
