No significant fiscal implication to the State is anticipated.
The bill would provide for gestational agreements. A gestational agreement is an agreement between a woman and the intended parents of a child in which the woman relinquishes all rights as a parent of a child conceived by assisted reproduction. The agreement is between the following parties: the prospective mother, her husband if she is married, each donor, and the intended parents. The bill would require that the intended parents be married. The bill requires the Texas Department of Health (TDH) to develop and implement a confidential reporting system to track assisted reproduction procedures under gestational agreements. TDH indicates minimal costs associated with such a system which could be reasonably absorbed within existing resources.
