HB732 by Martinez Fischer (Relating to the payment of costs incurred in executing arrest warrants for violations of the conditions of community supervision.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure by allowing a judge to require a defendant to pay a fee not to exceed $50 to cover the cost of executing a warrant for a violation of any conditions of community supervision.  Money raised by the bill may be used solely for the purpose of covering the cost to the local agency serving an arrest warrant and would not affect the operations of state government.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.  Fort Bend  and Tarrant counties reported that minimal computer programming costs would be needed to begin tracking the new fee.  Additional staff time would also be needed to distribute the fees to the arresting law enforcement agency. Collection of the additional fee would be dependent on the offender's ability to pay.
