LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 16, 2003

TO:
Honorable Helen Giddings, Chair, House Committee on Business & Industry

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB903 by Kolkhorst (Relating to the listing of a business location of certain businesses in a telephone directory or database.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill prohibits misrepresentation of the geographical location of a business if the business derives more than 50% of its gross income from the sale or arranging for the sale of flowers or floral arrangements.  A business is considered to misrepresent its location if it is not located in the geographic areas indicated, the listing fails to identify a geographical location, or a telephone to the business is routinely forwarded or transferred to a location outside the calling area identified in the listing.  The bill may result in new complaints, investigations or cases by the Office of the Attorney General, but it is anticipated that any additional workload could be absorbed by current resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
