No significant fiscal implication to the State is anticipated.
The bill would change provisions regarding penalties for operating a rock crusher or a concrete plant that performs wet batching, dry batching, or central mixing without a permit from a mandatory $10,000 fine per day to allow the Texas Commission on Environmental Quality to assess such penalties at its discretion, with a maximum penalty of $10,000 per day not to exceed 10 days.
Since penalties for this violation are relatively rare, it is not expected that the bill's provisions would result in a significant decrease in fee revenues deposited to the credit of the General Revenue Fund.
