LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 14, 2003

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1050 by Olivo (Relating to school attendance of a child placed in substitute care.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

Unless the child has a physical or mental condition of a temporary and remediable nature that makes attendance infeasible, the bill would require the Department of Protective and Regulatory Services (PRS) to return a child to school no later than the third day after a court order has provided for PRS' possession of a child. The bill would provide for a 30-day delay for submission of school enrollment documents in these cases. PRS indicates that its current policy is to return the child to school as soon as possible.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
