No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code by adding Section 411.1405 to allow state agencies access to criminal history record information maintained by the Department of Public Safety relating to certain persons who have access to information resources or information resources technologies. 

Prior to having access, the state agency would be required to adopt policies and procedures that provide that evidence of a criminal conviction or other relevant information obtained from the criminal history record would not automatically disqualify an individual from employment.  The Attorney General would be required to review the policies and procedures implemented by each agency prior to access to the criminal history information.  A fee to cover the cost of the policy review would be permitted.


Local Government Impact

No fiscal implication to units of local government is anticipated.
