No fiscal implication to the State is anticipated.

The bill would add Chapter 258 to Title 6, Transportation Code, to authorize a county with a population of less than 50,000 to clarify the existence of a public interest in a road by adopting a county road map that includes the road(s). The bill outlines the procedures for making clarification and for a person to protest and assert their right, title, or interest in a road in which the county has claimed the existence of a public interest. Included in the procedures would be holding a public meeting, publishing notice of the meeting, developing and displaying the proposed map, sending notice of the clarification to residents with their ad valorem tax statements, filing a warranty deed, and exempting from ad valorem taxes certain persons. Processes for reversion of the property if the county ceases to maintain the road are also included in the provisions of the bill.

 

The bill would take effect September 1, 2003.


Local Government Impact

According to the Texas Association of Counties, no significant fiscal implication to units of local government is anticipated.
